After completing this course, you’ll be able to analyze an insurance policy.
Upon successful completion of this course, you should be able to:
- Describe the following distinguishing characteristics of insurance policies:
- Indemnity
- Utmost good faith
- Fortuitous losses
- Contract of adhesion
- Exchange of unequal amounts
- Conditional
- Nontransferable
- Explain why some insurance policies do not have the distinguishing characteristics common to most insurance contracts.
- Explain the role of the courts in resolving coverage disputes:
- Compare questions of liability and questions of coverage.
- Compare questions of law and questions of fact.
- Describe waiver and estoppel.
- Describe an insurer’s alternatives in coverage disputes regarding property claims and liability claims.
- Describe the damages and other penalties that may be assessed against an insurer in a coverage dispute.
